Donald L. Berry Jr., 37, of East Alton, was charged on May 29, 2026 with one count each of aggravated fleeing or attempting to elude a peace officer (a Class 4 felony) and driving without a valid driver’s license.
Berry allegedly knowingly attempted to flee from an East Alton Police officer who had signaled for Berry to stop the vehicle he was driving on Wood River Avenue in East Alton on May 28, 2026.
Berry’s attempted flight from the officer reportedly involved the disobedience of two or more traffic control devices. His operation of the vehicle was unlawful given his lack of a valid driver’s license at the time of the offense.
According to the state’s petition to deny Berry’s pretrial release from custody, the officer attempted to conduct a traffic stop after seeing Berry commit several traffic violations. Berry reportedly ignored two stop signs and a traffic signal while fleeing from East Alton towards the Alton area at speeds over 75 mph in a 55 mph zone.
The East Alton officer was reportedly involved in a traffic accident and gave a description of Berry to officers with the Alton Police Department and Madison County Sheriff’s Office, who continued the pursuit after Berry stopped the vehicle in Alton and fled on foot into a nearby wooded area. Using the description from the East Alton officer, authorities were able to locate and apprehend Berry.
The petition notes Berry has multiple pending felony charges, including for unlawful possession of a controlled substance from a 2024 case in which he has repeatedly failed to appear in court and a pending aggravated battery charge from this earlier year for which Berry has had an active warrant since January.
The East Alton Police Department presented the latest case against Berry, who currently remains in custody at the Madison County Jail.
All individuals charged are presumed innocent until proven guilty in a court of law.
